Nebraska Has No Statewide Flavored Tobacco Ban

Unlike Massachusetts or California, Nebraska law does not restrict the sale of flavored cigarettes, cigars, smokeless tobacco, or open-system e-liquids. Neb. Rev. Stat. 28-1418 governs only the minimum sales age of 21, and the Tobacco Products Tax Act focuses on excise taxation rather than product composition. The federal premarket tobacco product application (PMTA) requirement and the FDA's restriction on flavored cartridge e-cigarettes other than tobacco and menthol still apply. Nebraska cities operate under broad home rule for licensing but firearm-style express preemption does not exist for tobacco; some local jurisdictions have considered point-of-sale licensing rules, but none currently enforce a flavor ban. Retailers must still verify age and comply with signage requirements under section 28-1418.01.

Federal FDA enforcement actions against unauthorized flavored cartridge sales include warning letters, civil money penalties, and seizure. State-level violations focus on age 21 noncompliance rather than flavor sales, with Class III misdemeanor penalties.
