Nevada Sanctuary Policy Status Under State Law

Nevada has not enacted a statewide preemption statute either requiring or banning local sanctuary policies regarding federal immigration enforcement. Unlike Texas SB 4 or California SB 54, Nevada law is silent on whether local law enforcement must honor ICE detainer requests or cooperate with federal immigration officials. Local jurisdictions, including Clark County, Washoe County, and the cities of Las Vegas and Reno, set their own policies regarding ICE cooperation, detainer compliance, and information sharing. Federal law under 8 USC 1373 still prohibits restrictions on sharing immigration status information with federal authorities. Nevada Attorney General opinions have addressed limits on local participation in 287(g) programs without state authorization.

There is no state penalty for sanctuary or non-sanctuary status because Nevada has no statewide preemption law on the subject; federal funding consequences may apply under federal law.
