New Hampshire Pool Barrier Building Code Requirements

RSA 155-A establishes the New Hampshire State Building Code, which incorporates the International Swimming Pool and Spa Code (ISPSC). Residential pools deeper than 24 inches must have a barrier at least 48 inches high with no openings allowing passage of a four-inch sphere. Gates must be self-closing, self-latching, and open outward with latches at least 54 inches above grade. Above-ground pools may use removable ladders as the barrier. The state code applies as a minimum standard across all municipalities. Towns may adopt stricter requirements through local amendments but cannot reduce safety standards. Enforcement occurs through local building officials.

Permit denial, certificate of occupancy refusal, and stop-work orders are common. Violations may carry civil penalties up to $275 per offense plus daily continuing violation fees under local enforcement.
