For condominiums, RSA 356-B:15 requires "the declarant, the board of directors, every unit owner, and all those entitled to occupy a unit" to comply with the condominium instruments, including the declaration, bylaws, and rules. Failure to comply gives rise to a suit "to recover sums due, for damages, [or] for injunctive relief" and "any other remedy available at law or in equity," with the prevailing party entitled to costs and attorneys' fees. Architectural-control and use restrictions are part of those instruments. New Hampshire has not adopted a comprehensive non-condo common-interest statute, so covenants, CC&Rs, and architectural-review provisions in a planned community are enforced as recorded equitable servitudes under property and contract law, with the association organized under RSA 292.

Condo covenant violations expose the owner to suit for damages or injunctive relief, plus costs and attorneys' fees to the prevailing party (RSA 356-B:15). Non-condo covenant enforcement depends on the recorded declaration interpreted by the courts.
