New Hampshire HOA Limits: Flags & Solar Access

RSA 356-B:47-a provides that, notwithstanding any condominium-instrument provision to the contrary, a unit owners' association "shall not prohibit the outdoor display of the United States flag in a manner consistent with the United States flag code," though it "may adopt reasonable rules regarding the size of the flag and the manner in which the flag is displayed." That protection is written for condominiums. New Hampshire's solar law (RSA 477:49 to 477:51) lets owners create and record a "solar skyspace easement" preserving "unobstructed access to solar energy," exempt from local zoning frontage and area requirements — but it is a voluntary, negotiated easement, not a blanket statute voiding HOA restrictions on solar panels. New Hampshire has not enacted a general statute barring HOAs from restricting political signs.

A condo rule banning the U.S. flag is unenforceable under RSA 356-B:47-a. No statutory penalty otherwise; solar and sign disputes turn on the recorded declaration and any negotiated easement.
