New Hampshire Sanctuary Policy Preemption Law

New Hampshire enacted HB 1292 in 2024, prohibiting any city, town, county, or law enforcement agency from adopting policies that restrict communication, cooperation, or information sharing with U.S. Immigration and Customs Enforcement and other federal immigration authorities. The statute requires local agencies to honor lawful federal detainers and to allow officers to inquire about immigration status when relevant to a criminal investigation. Existing sanctuary-style ordinances are voided, and the Attorney General may seek injunctive relief against noncompliant municipalities. Municipalities or officials maintaining sanctuary policies face Attorney General enforcement actions, possible loss of state grant funding, and personal exposure for willful obstruction.
