New Hampshire Single-Use Straw Regulation Status

Plastic straws are not regulated at the New Hampshire state level. Restaurants and retailers may distribute straws on demand or as default service. RSA 31:39 and RSA 149-M provide municipalities with authority to adopt local ordinances such as on-request straw rules. The state has not preempted these local efforts. Some hospitality businesses have voluntarily switched to paper or compostable straws to address environmental concerns.

No statewide penalties exist; any fines depend on individual municipal ordinances.
