New Mexico Uniform Owner-Resident Relations Act

NMSA 47-8-1 through 47-8-52 sets uniform statewide rules for residential landlord-tenant relationships, including the grounds and notice periods for terminating a tenancy. A landlord may terminate for nonpayment after a three-day notice (47-8-33), for material noncompliance after seven days, or by giving thirty days' notice to end a month-to-month tenancy without cause. Because the act is comprehensive and uniform, local governments cannot impose conflicting just-cause eviction requirements that lengthen notice or restrict statutory grounds for termination. Cities may, however, regulate landlord licensing and habitability inspections.

Eviction filings that fail to comply with statutory notice or grounds are dismissible. Wrongful eviction may expose a landlord to actual damages plus two months' rent under NMSA 47-8-36.
