New Mexico Agricultural Zoning and Farm Operations

Counties and municipalities in New Mexico may adopt zoning ordinances under NMSA 1978 Chapters 3 and 4 that designate agricultural districts, regulate land subdivision, and protect farmland from incompatible development. However, the Right to Farm Act under NMSA 47-9 limits the ability of local governments to retroactively restrict established agricultural operations through zoning changes. Counties commonly use agricultural zones to permit farming as a primary use, regulate confined animal operations, and require buffer zones for new residential development encroaching on existing farms. Conservation easements and agricultural land preservation programs supplement zoning protection.

Zoning violations typically carry civil penalties imposed by local code enforcement, with potential injunctive relief and abatement orders for noncompliant land uses.
