New Mexico Public Swimming Pool Safety Standards

Under NMAC 7.18.2, the New Mexico Environment Department regulates public, semi-public, and special use pools, spas, and aquatic facilities statewide. Rules require routine water quality testing for chlorine, pH, and microbial contamination; permitted plan review for new construction or major remodels; depth markings, safety signage, and approved drain covers per the Virginia Graeme Baker Act; and lifeguard or supervised access policies depending on facility type. Operators must maintain operating records and report serious incidents. Private single-family residential pools are not covered by NMED rules but remain subject to CID barrier code. Cities cannot lower these public pool standards but may add operating requirements.

Operating a public pool without a permit, failing water testing, or ignoring drain cover requirements can trigger NMED closure orders, civil penalties, and pool license suspension.
