North Dakota Paid Leave Mandate Status

North Dakota imposes no statewide mandate on private employers to provide paid sick leave, paid family leave, or paid time off. NDCC Title 34 addresses minimum wage, hours, and discrimination but does not establish a state-administered paid leave program. Federal laws, including the Family and Medical Leave Act for unpaid leave, still apply to qualifying employers. State employees receive paid leave under separate civil service rules. Because the state has not granted explicit local authority, attempts by cities to mandate private employer paid leave would likely be challenged under the framework of NDCC 34-06 wage preemption and home rule limits.

There are no state penalties because no statewide paid leave requirement exists. Employers must still comply with federal FMLA and other federal benefit laws, with FMLA violations enforced by the U.S. Department of Labor. Misrepresenting or failing to honor employer-promised paid leave policies may result in civil contract claims under state law.
