North Dakota Sanctuary City Policy Status

North Dakota has not enacted a statewide ban on sanctuary city policies, unlike several neighboring states. The state legislature has periodically considered sanctuary preemption bills, but none have been adopted into NDCC. As a result, cities, counties, and other political subdivisions retain home rule discretion over how their law enforcement agencies cooperate with federal immigration authorities, including responses to ICE detainer requests. Most North Dakota law enforcement agencies cooperate routinely with federal authorities, and no major North Dakota city has formally declared sanctuary status. State agencies follow federal immigration law where applicable, and NDCC 12.1-31 addresses certain identification and enforcement matters but does not mandate local immigration cooperation.

Because no statewide preemption exists, no state penalties apply to local sanctuary policies. Federal funding consequences may follow under federal law if local agencies violate 8 USC 1373 information-sharing requirements. Individual officers acting outside lawful authority may face civil liability under federal civil rights laws, but state law itself imposes no specific sanctioning mechanism for sanctuary-style policies.
