North Dakota Polystyrene Foam Local Rules

North Dakota law does not address polystyrene foam food containers, coolers, or packing peanuts at the statewide level. NDCC Title 23 environmental statutes focus on solid waste management and recycling but do not ban or restrict polystyrene products. Without state preemption, cities and counties retain authority under home rule to adopt their own polystyrene restrictions, recycling mandates, or labeling requirements. As of recent legislative sessions, no major North Dakota municipality has imposed a polystyrene ban, but the legal pathway remains open for local action.

State law imposes no penalties for polystyrene use. Enforcement depends on whatever local ordinances a city or county adopts, which typically include civil fines for retailers distributing prohibited items. Solid waste disposal rules under NDCC 23.1-08 still apply to commercial generators handling foam packaging.
