North Dakota Hot Tub and Spa Installation Standards

Residential hot tubs and spas under the state-adopted IRC are exempt from pool fencing if equipped with a lockable safety cover meeting ASTM F1346 standards. Electrical work is regulated under NDCC Chapter 43-09 (state electrical code adopting the NEC), which requires 240V hot tubs to be installed on a dedicated GFCI circuit by a licensed electrician with a permit. Bonding of metal components within 5 feet of the spa is mandatory. Public hot tubs at hotels, gyms, and apartment complexes require Department of Health permits under NDCC 23-19 with daily water testing and posted maximum-occupancy and time-limit signs. Local jurisdictions may add zoning restrictions but cannot lower technical safety standards.

Unpermitted electrical work is a class B misdemeanor under NDCC 43-09; public spas operating without health permits face closure and fines.
