Under NDCC 51-01.5, electronic smoking devices, vape liquids, and alternative nicotine products are regulated alongside traditional tobacco. Vending machine sales of vape products are prohibited outside age-restricted establishments. Retailers face inspections and compliance checks by the Attorney General. The statute also restricts internet and mail-order sales without proper age verification systems. Retail sales without a license, sales to minors, or self-service display violations carry civil penalties up to several hundred dollars per offense, escalating with repeat violations. Repeated violations can lead to license suspension or revocation under NDCC 51-01.5-04. Criminal penalties may apply for knowing sales to underage purchasers.
