Oklahoma Outdoor Burning and Burn Ban Statutes

Title 2 O.S. Section 16-26 authorizes the Governor and county boards of commissioners to issue burn bans when fire-weather conditions threaten public safety. During an active burn ban, all open flame, campfires outside designated containers, trash burning, and agricultural burning become unlawful regardless of municipal rules. Title 27A O.S. Section 2-5-105 and DEQ smoke-management rules also restrict burning that creates air-quality nuisances. Oklahoma Forestry Services publishes daily fire-danger ratings. Cities may add stricter year-round restrictions but cannot authorize burning during state-imposed bans.

Violating a burn ban is a misdemeanor punishable by fines up to $500 and up to one year in county jail. Fire-suppression cost recovery may also apply.
