Oklahoma HOA vs. City: Flag, Solar & Local Rules

Oklahoma gives HOAs broad latitude and only narrowly limits their covenants by statute. The clearest override is 60 O.S. § 858: an association "shall not adopt or enforce any policy... that would restrict or prevent a member... from displaying the flag of the United States at a reasonable height, not to exceed twenty (20) feet." There is NO Oklahoma statute protecting an owner's right to install solar panels over HOA objection; 60 O.S. § 820.1 is the "Airspace Severance Restriction Act" governing commercial wind/solar airspace severance, not residential HOA solar access. Group-home protections exist under 60 O.S. § 864. City zoning applies independently of HOA rules; the stricter generally controls.

No general penalty scheme. A member denied flag display contrary to 60 O.S. § 858 may seek to void/enjoin the offending policy; solar disputes are governed solely by the declaration, since no solar-rights statute exists.
