Oklahoma E-Verify Mandate for Public Employers

Under 25 O.S. 1313, every public employer in Oklahoma and every contractor or subcontractor performing work on a public contract must register with and participate in the federal E-Verify program to confirm the work authorization of newly hired employees. The mandate extends to state agencies, counties, municipalities, school districts, and public trusts. Contractors must verify status within three business days of hire, and failure to comply can result in contract termination and ineligibility for future public contracts. The statute is part of the Oklahoma Taxpayer and Citizen Protection Act of 2007, which also imposes penalties on businesses knowingly employing unauthorized workers. Private employers are encouraged but not generally required to use E-Verify, except when bidding on public contracts.

Failing to enroll in E-Verify, neglecting to verify new hires, or knowingly employing unauthorized workers may lead to contract loss, debarment, and additional civil penalties.
