Oklahoma Bans Local Rent Control

Oklahoma is a rent-control-preemption state. Okla. Stat. tit. 11 § 14-101.1(A) provides that "No municipal governing body may enact, maintain, or enforce any ordinance or resolution which regulates the amount of rent to be charged for privately owned, single-family or multiple unit residential or commercial rental property." Subsection (B) preserves a narrow set of exceptions: a municipality may still regulate property it owns, enter agreements that set rent for subsidized rental properties, and restrict rent for properties assisted with federal Community Development Block Grant funds. Because the legislature occupies this field, no Oklahoma city or town may impose rent control or a rent-increase cap on private landlords, and the state itself sets no ceiling on rent or rent increases.

Any local rent-control ordinance or resolution is void and unenforceable as preempted by Okla. Stat. tit. 11 § 14-101.1. A landlord could challenge such a measure in court, where it would be struck down; the state provides no penalty scheme because municipalities lack authority to adopt rent control in the first place.
