Oklahoma Plastic Straws Covered by State Preemption

Although not named explicitly, plastic straws are widely treated as auxiliary containers covered by 27A O.S. 2-11-201.1, which prevents local governments from imposing taxes, fees, or bans on disposable food service items. Restaurants may voluntarily switch to paper or compostable straws but cannot be required to do so by city ordinance. The Americans with Disabilities Act continues to require restaurants to provide flexible plastic straws upon request to customers with disabilities even when a business voluntarily phases them out.

Municipal ordinances banning or charging fees for plastic straws are preempted under state law and unenforceable against businesses.
