Oregon Does Not Preempt Breed-Specific Dog Rules

Oregon's state dangerous-dog framework (ORS 609.035 to 609.110) classifies 'potentially dangerous' and 'dangerous' dogs by documented behavior, such as menacing, biting a person, or killing livestock, not by breed. However, no Oregon statute bars cities or counties from adopting breed-specific ordinances, and the dog-control statutes expressly do not limit local governments' authority to regulate dogs. A city could therefore restrict or ban a breed, though few do. The former ORS 609.319 was renumbered in 2009 to ORS 609.341 and now governs exotic-animal permits, not dogs. Private insurers may also use breed-based underwriting.

A local breed ordinance is generally enforceable. An owner in a breed-restricting city must comply or face fines, impoundment, and other local penalties.
