Rhode Island Sanctuary Status and Local Authority

Rhode Island has not enacted a statewide law either mandating or prohibiting local cooperation with U.S. Immigration and Customs Enforcement, distinguishing it from states with explicit sanctuary preemption. The Rhode Island State Police operate under a 2014 policy generally limiting inquiries into immigration status during routine encounters, though this is administrative rather than statutory. Municipalities including Providence and Central Falls have adopted ordinances or executive orders restricting use of local resources for civil immigration enforcement and limiting honoring of ICE detainers absent a judicial warrant. Because the General Assembly has not preempted the field under any provision of Title 12 or Title 45, local governments retain discretion over policies, training, and information sharing. Federal law under 8 USC 1373 still bars outright prohibitions on sharing citizenship information.

There are no state penalties for sanctuary or non-sanctuary policies; disputes typically arise through federal grant conditions or civil litigation rather than Rhode Island statutory enforcement.
