Rhode Island Has No Statewide Rent Control and Does Not Address Local Authority

Rhode Island's Residential Landlord and Tenant Act (R.I. Gen. Laws Title 34, Chapter 18) does not address rent control or rent stabilization, and no statewide statute imposes a cap on rent increases. Because the statute is silent rather than expressly preemptive, the question of municipal authority turns on the Home Rule Amendment and whether the state has "occupied the field" — an unsettled legal question. For month-to-month tenancies, a landlord must give written notice (30 days, or longer for older tenants) before a rent increase under § 34-18-16.1, but no law limits the amount of that increase.

There is no statewide rent-control penalty because Rhode Island imposes no rent cap. A landlord raising rent must still comply with the written-notice requirements of R.I. Gen. Laws § 34-18-16.1 for month-to-month tenancies.
