South Dakota state law: ADU building permits and approvals

Unlike many states, South Dakota does NOT adopt a uniform statewide residential building code. Each municipality and county adopts its own version of the International Code Council I-Codes (IRC, IBC, IMC, IPC, IECC, IFC) by reference. The SDCL Chapter 11-4 municipal-zoning enabling act and SDCL Chapter 11-2 county-zoning enabling act provide the textual authority for local building-permit programs. An ADU build (whether detached new construction, attached addition, basement conversion, or garage conversion) requires (1) a zoning-compliance review for use, lot coverage, setbacks, height, and parking; (2) a building permit from the local building department covering framing, foundations, fire-separation under IRC R302 (attached units), insulation/envelope under the locally adopted IECC, mechanical (heat source), electrical service capacity, and plumbing; (3) inspections (footing, framing, rough-in, insulation, final); (4) a Certificate of Occupancy or final inspection sign-off before lawful occupancy. Where the local jurisdiction has NO explicit ADU zoning provision, a special-use permit, conditional-use permit, or variance from the Board of Adjustment (SDCL 11-4-21 for cities; SDCL 11-2-49 for counties) is typically required BEFORE the building permit will be issued. South Dakota has no state-mandated ADU permit-processing timeline, no state-mandated ministerial-approval pathway, and no state preemption of local discretionary review (contrast California Government Code 65852.2(b) 60-day approval mandate).

Building an ADU without required permits exposes the owner to stop-work orders, daily civil penalties under the local code, mandatory demolition orders, and ineligibility for occupancy. Unpermitted electrical or plumbing work may also trigger insurance non-coverage and difficulty selling the property. Permit fees, plan-review fees, and inspection fees are set locally.
