South Dakota Statewide Rule
South Dakota has no statewide garage-conversion statute and no ADU-preemption law facilitating garage-to-ADU conversion (contrast California, Colorado, and Maine). Garage conversion to habitable space is a change-of-use under the locally adopted International Residential Code (IRC) and requires a building permit from the city or county building department. SDCL Chapter 11-4 (municipal zoning) and SDCL Chapter 11-2 (county zoning) govern.
