South Dakota state law: converting a garage to habitable living space

Converting an attached or detached garage to living space (bedroom, in-law suite, home office, or accessory dwelling unit) in South Dakota requires a building permit from the local building department. South Dakota has NOT enacted a statewide ADU preemption — there is no analog to California Government Code §§ 65852.2/65852.22, Colorado HB24-1152, or Maine 30-A MRS § 4364-A. Garage conversion is governed entirely at the local level under SDCL Chapter 11-4 (municipal zoning), SDCL 6-12 charter authority (Sioux Falls, Rapid City, Watertown), and SDCL Chapter 11-2 (county zoning in unincorporated areas). Each jurisdiction adopts the IRC change-of-use provisions, which require permit review for: (1) IRC R310 emergency-escape-and-rescue openings — at least one operable window in each habitable room meeting minimum size; (2) IRC R305 minimum ceiling height of 7 ft in habitable rooms; (3) insulation and energy compliance under the locally adopted International Energy Conservation Code (IECC), with cold-climate minimums (SD building officials typically require R-49 ceiling, R-21 wall, R-30 floor); (4) heating capacity sufficient to maintain 68°F per IRC R303.9; (5) electrical service upgrade and AFCI/GFCI per the National Electrical Code (NEC); (6) plumbing rough-in and venting under the locally adopted IPC or UPC when a bathroom or kitchen is added; (7) smoke and carbon-monoxide alarms — SDCL Chapter 34-45 requires CO alarms in residential dwellings with fuel-fired appliances or attached garages. Conversion of an attached garage that eliminates the required off-street parking spaces may also trigger a zoning variance or off-street-parking-replacement requirement, depending on the local zoning code. If the converted space will function as an ADU (separate kitchen, separate entry, separately rented), additional zoning approval (special-use permit, conditional-use permit, or rezoning) is typically required.

Performing a garage conversion without a building permit may trigger stop-work orders, daily fines, and an after-the-fact permit requirement (often with double fees). Unpermitted converted space typically cannot be advertised as a bedroom on a real-estate listing and may have to be removed prior to sale. Unsafe converted space (no egress window, no heat, no smoke alarms) may be declared a public nuisance under SDCL Chapter 9-32 and SDCL 21-10-1, abated by the city at owner expense.
