South Dakota state law: backyard chickens and livestock delegated to municipalities (SDCL Title 40)

South Dakota is a livestock-state with deep agricultural roots, and the codified laws reflect that. SDCL Title 40 (Animals and Livestock) — including Chapter 40-1 (Livestock Generally) and Chapter 40-13 (Brand Inspection) — regulates commercial cattle, horses, sheep, swine, goats, and bison for purposes of brand inspection, animal-health certification, and at-large/trespass liability. The state does NOT impose a statewide cap on the number of backyard chickens, ducks, rabbits, or other small livestock a residential property owner may keep. Residential chicken-keeping ordinances (typical limits: 4-8 hens, no roosters, coop setback 10-15 ft from property lines, no on-site slaughter inside city limits) are set by city ordinance under SDCL 9-29-1 (general welfare police power) and SDCL Chapter 11-4 (municipal zoning) for statutory cities, under SDCL 6-12 charter authority for home-rule cities (Sioux Falls, Rapid City, Watertown), and under SDCL Chapter 11-2 for counties in unincorporated areas. Sioux Falls authorizes backyard hens under Municipal Code Title 90; Rapid City operates a chicken-keeping permit program. Rural unincorporated land outside city limits generally permits chickens and small livestock as a matter of right consistent with the underlying agricultural zoning, given the livestock-industry heritage. SDCL 40-34-1 (livestock-protection killing privilege) reflects the same agricultural orientation: killing a dog in the act of disturbing or destroying domestic animals (sheep, cattle, swine, poultry) is lawful. The practical effect: SD law is exceptionally permissive on residential animal-keeping at the state level — restrictions come from your specific city or county code.

No state-law penalty for residential chicken or small-livestock keeping. Municipal-code violations (exceeding hen counts, keeping prohibited roosters, coop setback noncompliance, illegal slaughter) are typically civil infractions with fines of $50-$500 per day plus required removal of the flock. Commercial livestock operations that fail brand inspection under SDCL 40-13 face state-level fines and seizure.
