South Dakota Statewide Rule
South Dakota has no statewide leash law. Authority over dogs running at large is delegated to municipalities under SDCL Chapter 9-40 and to counties under SDCL Chapter 7-12. Most South Dakota cities require dogs in public to be leashed (typically 6 feet or less), while rural agricultural land generally permits free-running dogs subject to livestock-protection statutes. SDCL 40-34-1 allows a person to lawfully kill a dog caught in the act of disturbing or destroying domestic animals (sheep, cattle, swine, poultry) — a strong reflection of South Dakota's livestock-state heritage.
