South Dakota state law: pool barrier / fencing requirements

The South Dakota Codified Laws do not include a swimming-pool barrier statute. Residential pool-barrier requirements are imposed in two ways. First, the International Swimming Pool and Spa Code (ISPSC) and International Residential Code (IRC) Appendix G are adopted by reference into each local building code: typically requiring a barrier minimum 48 inches high (measured on the side facing away from the pool); no more than 4 inches between vertical members; no more than 2 inches between the bottom of the barrier and grade; a self-closing and self-latching gate with the latch release a minimum 54 inches above grade and opening outward away from the pool; and either an isolation fence between the dwelling and the pool, or pool alarms on all doors providing direct access to the pool. Second, common-law premises-liability exposure under the South Dakota attractive-nuisance doctrine applies to unfenced backyard pools accessible to children. Public swimming pools (apartment, HOA, hotel, club) are additionally regulated by the South Dakota Department of Health under SDCL Chapter 34-18A (Bathing Places) and ARSD Article 44:02:05, but those state rules do NOT cover single-family residential backyard pools. Authority for local building-code adoption flows from SDCL Chapter 11-4 (municipal) and SDCL Chapter 11-2 (county).

Pool-barrier violations are enforced by the local building department under local code, typically resulting in a stop-work order or red-tag, after-the-fact permit and inspection fees, and a requirement to bring the barrier into compliance before re-filling or re-opening the pool. Civil liability for an injury or drowning on a noncompliant pool may be pursued under the attractive-nuisance doctrine. There is no state-level criminal penalty for a barrier violation.
