South Dakota state law: no statewide defensible-space mandate

There is no statewide defensible-space mandate in South Dakota — neither for the Black Hills wildland-urban-interface (Pennington, Lawrence, Custer, Meade counties) nor for prairie-edge subdivisions. State authority over wildland fire is concentrated in the South Dakota Wildland Fire Division within DANR (created under SDCL §41-20A), which has authority for prevention, fire-mutual-aid coordination, and statewide fire-danger suspensions under SDCL §34-37-16.1 — but no power to order private brush clearance. Vegetation and brush management is delegated through three mechanisms: (1) SDCL Chapter 9-32 (Garbage, Waste, and Nuisances) and SDCL §9-32-13 authorize municipalities to declare overgrown weeds, brush, or rank vegetation a public nuisance and to abate at owner expense after notice. Typical city ordinances cap residential vegetation at 8-12 inches in height. (2) SDCL Chapter 11-2 (county zoning) and SDCL §7-12 (county sheriff/nuisance authority) extend similar abatement power to counties for unincorporated parcels. (3) SDCL Chapter 38-22 (Weed and Pest Control) imposes a mandatory duty on every landowner to control state-listed noxious weeds (Canada thistle, leafy spurge, purple loosestrife, salt cedar, perennial sow thistle, hoary cress, Russian knapweed, plumeless thistle, musk thistle, absinth wormwood, yellow toadflax) under SDCL §38-22-19, enforced by county weed-and-pest boards. Black Hills WUI defensible-space rules (where they exist — for example Custer County or homeowner-association requirements) are local, not state-mandated.

There is no SDCL section directly penalizing failure to clear residential brush. Enforcement runs through (a) municipal nuisance abatement under SDCL §9-32-13 — typically a written notice to abate within 5-10 days, after which the city mows at owner expense and the cost becomes a lien on the property under SDCL §9-32-15; (b) county nuisance abatement under SDCL Chapter 7-8; and (c) state noxious-weed enforcement under SDCL §38-22-23 — county weed supervisors may enter property to control noxious weeds and bill the landowner. Failure to control noxious weeds after notice is a Class 2 misdemeanor under SDCL §38-22-25.
