South Dakota state law: backyard recreational fire pits

South Dakota is one of a handful of states that does not adopt a statewide building or fire code; each county and municipality decides whether to adopt the International Fire Code (IFC), International Residential Code (IRC), or related I-Codes. As a result, SDCL is silent on recreational fire-pit dimensions, clearances, and fuel types. The state-level framework is layered: (1) SDCL §34-37-19 (Power of county to restrict fireworks and other fire-causing activities) authorizes a board of county commissioners to adopt an ordinance imposing restrictions on activities likely to cause a fire, tied to the South Dakota Grassland Fire Danger Index published by the South Dakota Wildland Fire Division; that statutory hook is the most common basis for county-imposed recreational-fire bans during elevated-danger periods. (2) SDCL §9-29-1 grants every municipality the police power to promote the 'health, safety, morals, and general welfare of the community,' which is the textual basis for city fire-pit rules. (3) Cities that adopt the IFC by reference apply IFC §307 (Open Burning, Recreational Fires, and Portable Outdoor Fireplaces) — typically requiring recreational fires to be no more than 3 ft in diameter and 2 ft in height, located at least 25 ft from any structure or combustible material, with portable outdoor fireplaces at least 15 ft from structures, attended at all times, and with a means of extinguishment within reach. (4) South Dakota DANR Air Quality rules (ARSD 74:36:06:07) restrict the materials that may be burned in any open fire (no rubber, tires, treated wood, asphalt shingles, oils, electrical wire, hazardous waste, or asbestos materials) even when local rules otherwise allow a recreational fire. Sioux Falls (home-rule, SDCL §6-12) and Rapid City (home-rule) both regulate recreational fires through municipal code under their charter authority.

There is no SDCL section that directly penalizes a non-compliant residential fire pit. Violations are enforced at the county or city level: per SDCL §34-37-19, violation of a county fire-restriction ordinance is a Class 2 misdemeanor (up to 30 days in county jail and/or a $500 fine under SDCL §22-6-2). Municipal fire-code violations are typically Class 2 misdemeanors under SDCL §9-19-3 (cities may set penalties up to a Class 2 misdemeanor) or municipal infractions with civil fines. ARSD 74:36 violations (burning prohibited materials) are enforceable by DANR under SDCL §34A-1.
