South Dakota state law: LP-gas regulated by State Fire Marshal under SDCL Chapter 34-32

Propane is regulated statewide by SDCL Chapter 34-32 (Liquefied Petroleum Gas), which is administered by the South Dakota State Fire Marshal Division within the Department of Public Safety (SDCL §34-29-1 et seq. establishes the State Fire Marshal). The State Fire Marshal has authority under SDCL §34-32-4 to adopt rules — currently ARSD 20:54 — that incorporate the National Fire Protection Association's NFPA 58 (Liquefied Petroleum Gas Code) by reference, governing the design, installation, location, and operation of LP-gas systems. Key NFPA 58 setbacks for residential aboveground propane tanks: 125-gallon tanks must be at least 10 ft from buildings, property lines, and ignition sources; 500-gallon tanks (typical for whole-house heating) must be at least 10 ft from buildings and property lines; 1,000-gallon tanks must be at least 25 ft. Disposable 1-pound cylinders and grill-sized 20-pound cylinders are exempt from most setback requirements but must not be stored inside dwellings or in occupied buildings. Under SDCL §34-32-3 and §34-32-4, every person who sells, installs, services, transports, or fills LP-gas containers must hold a State Fire Marshal license. SDCL §34-32-7 requires that LP-gas trucks be registered with the State Fire Marshal. Municipalities cannot adopt LP-gas regulations less stringent than state rules but may add fire-code provisions through local IFC adoption (IFC Chapter 61, formerly Chapter 38).

Operating an unlicensed LP-gas business, or violating any rule adopted under SDCL Chapter 34-32, is a Class 2 misdemeanor under SDCL §34-32-9 (up to 30 days in county jail and/or $500 fine), and each day of violation may be charged as a separate offense. The State Fire Marshal may issue stop-work orders, revoke licenses, and impose administrative penalties. Civil liability under common law for negligent storage or installation that causes injury or property damage is also available.
