South Dakota state law: Grassland Fire Danger Index and Black Hills WUI; no statewide hazard-zone map

South Dakota's wildfire framework is administered by the South Dakota Wildland Fire Division (formerly the Division of Wildland Fire Suppression), housed within the Department of Agriculture and Natural Resources Conservation Division. The division's enabling authority is SDCL Chapter 41-20A. Unlike CAL FIRE in California or the Colorado State Forest Service, the SD Wildland Fire Division does not maintain a codified statewide hazard-zone map. Instead, the state's primary wildfire-risk signaling tool is the South Dakota Grassland Fire Danger Index (GFDI), a daily 5-level rating (low, moderate, high, very high, extreme) published by the Wildland Fire Division using National Weather Service inputs. The GFDI is the statutory trigger embedded in SDCL §34-37-19, which authorizes county commissioners to adopt ordinances restricting fireworks and fire-causing activities when the index reaches specified levels — violation is a Class 2 misdemeanor. SDCL §34-37-16.1 authorizes the Wildland Fire Division to impose statewide suspensions on fireworks and other ignition sources during elevated-danger periods. The Black Hills region (the four western counties of Pennington, Lawrence, Custer, and Meade, plus Fall River) is the state's principal wildland-urban-interface area, with extensive ponderosa pine cover and developed residential acreage — but defensible-space and WUI building-code requirements there are set locally (county or city ordinance, US Forest Service for federal land), not by SDCL. State law does not require home hardening, ember-resistant venting, or Class A roof assemblies — those would be locally adopted IRC/IWUIC code amendments.

Violation of a county fire-restriction ordinance adopted under SDCL §34-37-19 is a Class 2 misdemeanor (up to 30 days in county jail and/or $500 fine under SDCL §22-6-2). Violation of a Wildland Fire Division statewide suspension under SDCL §34-37-16.1 is enforceable as a Class 2 misdemeanor. Intentional ignition of a fire that damages property is arson under SDCL Chapter 22-33 — 1st-degree arson is a Class 2 felony (SDCL §22-33-9.1). Civil liability under common law for negligently setting a fire that escapes is also available. SDCL §41-20A-12 authorizes the Wildland Fire Division to recover suppression costs from a person whose negligence caused the fire.
