South Dakota state law: grass and weed height

SDCL 9-29-1 grants every municipality power to exercise jurisdiction within and one mile beyond its corporate limits 'for the purpose of promoting the health, safety, morals, and general welfare of the community.' SDCL Chapter 9-32 supplies the parallel nuisance-abatement and garbage/waste authority. Together these statutes are the textual hook for South Dakota cities to declare overgrown grass, weeds, and unkempt yards a public nuisance and to mow at the owner's expense after notice and opportunity to cure. There is no statewide maximum height number; thresholds are set municipality by municipality. In the unincorporated county, county zoning under SDCL Chapter 11-2 plus the county weed and pest board under SDCL Chapter 38-22 supply the enforcement mechanism. Home-rule cities (Sioux Falls, Rapid City, Watertown) act under their SDCL 6-12 charter; statutory cities act under SDCL 9-29-1.

Violators receive a written notice to mow within a short cure period (typically 5 to 10 days). If the property owner does not comply, the city mows and bills the owner; unpaid abatement charges may be certified to the county auditor and added to the property tax bill as a special assessment under SDCL 9-32 nuisance-abatement procedures. Each day of continued violation can be a separate offense under local ordinance.
