South Dakota state law: tree trimming rules

South Dakota Codified Laws contain no general statute requiring a permit to trim trees on private residential property. Two state-law touchpoints matter. First, investor-owned electric utilities and rural electric cooperatives operate under SDCL Chapter 49-34A (Electric Utility Service) and South Dakota Public Utilities Commission rules, which authorize vegetation management within transmission and distribution right-of-way easements consistent with ANSI A300 pruning standards. Utilities must give advance notice to affected property owners before non-emergency trimming. Second, South Dakota common law (consistent with the majority Massachusetts/Restatement rule) lets a neighbor trim back overhanging branches and intruding roots to the property line at the neighbor's own expense, but the trimmer is liable if the trim kills or seriously damages a healthy tree on the adjoining parcel. There is no state heritage-tree or protected-species residential trim restriction. Most cities require a permit and a licensed arborist to trim trees in public right-of-way (street trees and park trees) under SDCL Chapter 9-38 (streets and sidewalks) and the local forestry code. Sioux Falls Forestry Division, Rapid City Parks and Recreation Forestry, and many smaller cities maintain Tree City USA programs with public-tree pruning standards.

Damaging or removing a city-owned street tree without a permit is typically a municipal civil infraction with restoration or replacement-cost recovery. Damaging a neighbor's healthy tree while exercising self-help boundary-line trimming can lead to a civil suit for treble damages under SDCL 21-3-3 (timber-trespass damages) in some circumstances. Utility trimming without complying with the PUC notice rule can lead to PUC enforcement under SDCL Chapter 49-34A.
