South Dakota state law: outdoor watering restrictions

SDCL Title 46 (Water Rights) administers South Dakota's prior-appropriation system: any use of water beyond domestic supply requires a water-right permit from the South Dakota Department of Agriculture and Natural Resources (DANR) Water Rights Program. Municipal water suppliers hold their own permits and may impose customer use restrictions to stay within permitted withdrawal limits. SDCL Chapter 9-47 grants every municipality power to construct, maintain, and operate waterworks and to fix rules and rates for water service — the textual hook for emergency drought ordinances, watering schedules, and irrigation bans. SDCL 9-29-1 supplies the general welfare backup. There is no statewide residential outdoor watering schedule. Sioux Falls, Rapid City, and other SD cities periodically impose voluntary or mandatory drought-stage watering limits (typical: odd/even address-based watering days, watering prohibited between 10 a.m. and 6 p.m.) tied to reservoir levels or aquifer drawdown. Private wells used for domestic supply are exempt from DANR water-right permitting under SDCL 46-1-6 but may still be subject to local well-construction rules.

Violations of municipal watering restrictions are typically civil infractions or petty offenses under local ordinance with progressive fines (commonly $50 to $500 escalating per offense) and possible water-service shutoff for repeated noncompliance. Violations of state water-right permits or use of unpermitted water are administered by DANR with potential cease-and-desist orders and civil penalties under SDCL Title 46.
