Critically, SDCL 40-34-16 (effective 2014) prohibits all South Dakota local governments, including home-rule cities, from enacting any rule 'specific as to the breed or perceived breed of a dog,' but this preemption does NOT limit local authority over barking nuisance, which by its nature is breed-neutral.
