South Dakota state law: construction-hour limits

No section of SDCL Title 22 (Crimes), Title 32 (Motor Vehicles), Title 34 (Public Health), or Title 60 (Labor) sets a statewide window during which construction equipment, jackhammers, framing crews, or roofing nail guns may operate. The state-law authority for local construction-hour ordinances flows from SDCL 9-29-1, which authorizes municipalities to legislate 'for the purpose of promoting the health, safety, morals, and general welfare of the community,' and from SDCL Chapter 9-32 (garbage, waste, and nuisance abatement) which underlies municipal nuisance enforcement. SDCL 22-18-35 (disorderly conduct - unreasonable noise made with purpose to cause public danger or alarm) is the only state-law criminal backstop, but it requires intentional public alarm and is not a workable construction-hour tool. Counties operating under SDCL Chapter 11-2 zoning can impose construction-hour conditions through conditional-use permits. Each city ordinance specifies the actual permitted window, exceptions (emergency utility work, interior finishing, snow removal), and decibel caps.

Disorderly conduct (SDCL 22-18-35) is a Class 2 misdemeanor (up to 30 days/$500). Local construction-hour ordinances carry civil fines, typically $100-$500 per day of violation, plus stop-work orders. State law adds no separate construction-specific penalty.
