South Dakota state law: residential quiet hours

There is no codified statewide quiet-hours window in SDCL — every fixed start/end time and every decibel-at-property-line threshold in South Dakota is local. The state-law floor comes from two sources. SDCL 21-10-1 defines a nuisance as 'unlawfully doing an act, or omitting to perform a duty, which... annoys, injures, or endangers the comfort, repose, health, or safety of others.' SDCL 22-18-35 makes it a Class 2 misdemeanor to intentionally cause 'serious public inconvenience, annoyance, or alarm' by 'making unreasonable noise' with purpose to cause public danger or alarm. SDCL 9-29-1 is the textual hook for local quiet-hours ordinances: it grants every municipality power 'for the purpose of promoting the health, safety, morals, and general welfare of the community.' Sioux Falls, Rapid City, and Watertown additionally rely on SDCL 6-12 home-rule charter authority. Typical adopted windows mirror national norms (10 p.m. to 7 a.m. weekdays, 11 p.m. to 8 a.m. weekends) with property-line dBA caps in the 50-55 dBA range at night, but those are local decisions, not state mandates.

Disorderly conduct under SDCL 22-18-35 is a Class 2 misdemeanor (up to 30 days jail and/or $500 fine). Civil nuisance abatement, damages, and injunctions are available under SDCL Chapter 21-10. Local-ordinance penalties are typically civil fines of $50-$500 per occurrence and run separately from the state misdemeanor.
