South Dakota state law: STR insurance requirements

The South Dakota Division of Insurance, within the Department of Labor and Regulation, administers Title 58 but has issued no STR-specific insurance bulletin requiring minimum liability limits. Standard South Dakota homeowner policies (HO-3) typically exclude business use of a dwelling, meaning that an unmodified HO-3 may not cover STR liability or loss claims. Operators commonly add a Home-Sharing Endorsement, switch to a Landlord/Dwelling Fire (DP-3) policy, or purchase a separate commercial general liability policy. Airbnb's AirCover and Vrbo's Liability Insurance program provide platform-side host protection up to $1,000,000 per occurrence for covered bookings, but South Dakota has not codified any minimum coverage that displaces or supplements these private programs. STR ordinances in some SD cities require proof of insurance as a permit-application attachment - check the local code.

No state-level violation exists for failure to carry STR insurance. Local violations are misdemeanor or civil-penalty offenses under the host city's STR ordinance. Operating without an HO-3-endorsement or commercial policy after an STR loss may result in claim denial under standard policy exclusion language - a private contractual risk, not a state-law violation.
