South Dakota state law: holiday lights and seasonal displays

The South Dakota Codified Laws do not address residential holiday or seasonal displays. Each city and county may set its own rules through zoning or property-maintenance code under SDCL Chapter 11-4 (Municipal Zoning), SDCL Chapter 11-2 (County Zoning), and SDCL 6-12 charters for the home-rule cities of Sioux Falls, Rapid City, and Watertown. SDCL 9-29-1 supplies the police-power hook for statutory cities. Common local rules: prohibit obstruction of the public sidewalk or street; require removal of seasonal lighting within a fixed window after the holiday (typically 30 days post-holiday or by mid-February for winter displays); require compliance with the locally adopted National Electrical Code (NEC, typically through the IRC) for outdoor electrical installations including weather-rated GFCI-protected receptacles and outdoor-rated extension cords; and may impose decibel or curfew limits on display-associated music. Animated/amplified holiday displays attracting traffic congestion or generating noise can trigger nuisance liability under SDCL 21-10-1 ('a nuisance includes any act which annoys, injures, or endangers the comfort, repose, health, or safety of others') and disorderly-conduct exposure under SDCL 22-18-35 (Class 2 misdemeanor for unreasonable noise). Light-trespass complaints (high-lumen LED displays affecting neighbors' sleep) are handled under local nuisance code authorized by SDCL Chapter 9-32. Inflatables and roof-mounted decorations occupying public right-of-way are subject to local sign/encroachment ordinances. There is no state First Amendment carve-out for religious displays on private property — owners may display crèches, menorahs, or seasonal symbols on their own property subject to neutral local rules.

There is no state-level penalty for a holiday-display violation. Enforcement is by municipal or county code citation under local code, typically requiring the homeowner to remove or modify the display after written notice. Persistent loud or traffic-generating displays may be abated as nuisances under SDCL 21-10-1 (civil) or prosecuted as disorderly conduct under SDCL 22-18-35 (Class 2 misdemeanor — up to 30 days in jail and/or $500 fine).
