South Dakota Polystyrene Foam Container Rules

South Dakota law does not restrict expanded polystyrene foam cups, plates, or takeout containers. SDCL 34A-6 and SDCL 34A-16 address solid waste and recycling, but they do not regulate single-use foam products. Cities operate under Dillon's Rule with limited express authority over packaging, and no South Dakota municipality has enacted a polystyrene ban. Federal labeling rules and OSHA workplace standards still apply to foam manufacture.

There are no state penalties for polystyrene use; local bans would face legal challenge as exceeding municipal authority under SDCL Title 9.
