South Dakota Plastic Straw Rules and Policy

Plastic straws are not regulated as single-use items under South Dakota law. SDCL 34-18 governs food service licensing through the Department of Health, but contains no straw distribution standards. Restaurants may offer plastic, paper, or compostable straws at their discretion. No municipality has enacted an upon-request straw ordinance, and any such local rule would raise authority questions under Dillon's Rule and SDCL 9-29.

There are no straw-specific penalties under state law; food service violations unrelated to straws fall under SDCL 34-18 sanitation enforcement.
