South Dakota state law: above-ground pools

Because South Dakota has not adopted a uniform statewide building code, above-ground pool requirements vary across the state. Where the locally adopted IRC Appendix G or ISPSC applies, an above-ground pool with a wall at least 48 inches high may serve as part of the required barrier itself, provided that any ladder is removable, securable, or surrounded by a barrier so that a child cannot climb to the deck. Below the 48-inch threshold, a separate code-compliant perimeter barrier is required. Above-ground pool electrical wiring must satisfy NEC Article 680 bonding and grounding regardless of pool type. Zoning setbacks (typically 5 to 10 feet from side and rear property lines, prohibition from front yards) and any maximum-size or maximum-height rules are also set by the local zoning code. Above-ground pools sold as portable or temporary may be exempt from building permit requirements in some jurisdictions but still trigger attractive-nuisance liability if not properly secured.

Enforcement is local. Typical consequences include building permit citations, stop-work orders, fines, and orders to install a compliant ladder enclosure or perimeter barrier. The common-law attractive-nuisance doctrine applies regardless of pool type — owners can face civil liability for injuries to children who climb into an unsecured above-ground pool.
