South Dakota Statewide Rule
South Dakota has no swimming pool fencing or barrier statute. Pool barrier requirements come from two sources: (1) the International Residential Code Appendix G and the International Swimming Pool and Spa Code (ISPSC), adopted by reference by each county and city under SDCL Chapter 11-4 building code authority; and (2) common-law attractive-nuisance liability for failure to protect children from an unfenced backyard pool.
