South Dakota Flavored Tobacco Sales Without Statewide Ban

Unlike several states, South Dakota does not restrict flavored cigarettes, cigars, or vapor products at the state level. Federal law bans most characterizing flavors in cigarettes and recently restricts certain flavored vape cartridges, but menthol cigarettes, flavored cigars, and refillable flavored e-liquids generally remain legal for sale to adults 21 and over. Local ordinances are limited by state preemption considerations under SDCL 34-46.

There are no state-specific flavor ban penalties; federal violations of FDA flavor restrictions can lead to civil penalties and product seizures.
