Utah Local Paid Leave Mandate Preemption

Utah does not require private employers to provide paid sick leave, paid family leave, or paid time off, and state law preempts local mandates that would impose such requirements on private businesses. The Legislature has consistently treated employment benefit standards as a matter of statewide concern. Local governments may set leave policies for their own public employees but cannot mandate paid leave for private-sector workers. Federal Family and Medical Leave Act (FMLA) requirements apply for unpaid job-protected leave at qualifying employers, and federal pregnancy and disability protections continue to govern accommodation obligations.

Local paid leave mandates conflicting with state preemption are void; violations of federal FMLA requirements may trigger Department of Labor enforcement.
