West Virginia Paid Leave Authority and Local Limits

Beyond federal FMLA, West Virginia does not require private employers to provide paid sick leave, paid family leave, or paid vacation. State employees have leave benefits under separate civil service rules. Localities operate under home-rule and police-power constraints; they have not enacted paid leave mandates on private employers, and any such ordinance would face challenge under the comprehensive wage and hour scheme in W. Va. Code 21-5 and 21-5C. Employers should follow contracts and federal leave laws.

Failing to comply with contracted paid leave benefits can be enforced as a wage claim under W. Va. Code 21-5-4 with potential liquidated damages.
