West Virginia E-Verify Requirements

West Virginia has not enacted a comprehensive statute requiring all employers to use the federal E-Verify system to confirm employment eligibility. Employers must comply with federal Form I-9 obligations under the Immigration Reform and Control Act, and certain public contractors or recipients of state benefits may face program-specific requirements. The state has from time to time considered broader E-Verify legislation, but no general mandate has been codified in W. Va. Code. Employers participating in E-Verify do so largely on a voluntary basis or because of federal contractor obligations.

There is no general state penalty for failing to use E-Verify because no universal mandate exists; federal I-9 violations remain enforceable by federal authorities.
