Wyoming Late Fee Rules

Neither the Residential Rental Property Act (Wyo. Stat. §§ 1-21-1201 et seq.) nor any other Wyoming statute limits the amount of a late rent fee, requires a grace period before a fee applies, or dictates how late fees must be disclosed. Because the subject is unregulated, late fees are a matter of contract: a fee is enforceable if it is agreed in the rental agreement and is not so disproportionate that it functions as an unenforceable penalty under general contract principles. Wyoming's eviction track is separate — under Wyo. Stat. § 1-21-1002 a landlord may begin a forcible entry and detainer action after rent is unpaid for three days, regardless of any late-fee terms.

No specific statutory penalty. With no statute, a tenant challenging a late fee must rely on the rental agreement or argue under common law that the charge is an unenforceable penalty rather than a reasonable estimate of damages.
