Wyoming Flavored Tobacco and Vape Policy

Wyoming statutes do not prohibit the sale of flavored cigars, smokeless tobacco, menthol cigarettes, or flavored vapor products beyond federal Tobacco Control Act rules. Federal FDA enforcement bans most flavored cartridge-based e-cigarettes other than tobacco and menthol, but disposable vapes and open-system liquids remain widely available. Wyoming retailers must still verify age (Tobacco 21) and comply with packaging and labeling requirements under state and federal law. Local governments lack authority to enact stricter flavor bans under preemption practices applicable to tobacco regulation.

Selling federally banned flavored cartridges is subject to FDA enforcement actions and seizure; state-level violations focus on age restrictions and licensing rather than flavor content.
